For international pharma teams entering India, emerging biotechs preparing commercial activity and compliance leaders coordinating product, channel and state-level requirements.
India combines central laws and national marketing-practice requirements with state-level administration of drug manufacture, sale and distribution. Companies also need to operationalise detailed controls for promotional claims, HCP interactions, samples, education programmes and annual marketing-expenditure disclosures.
从要求到行动
We can map activities to the applicable national framework, identify state-specific licensing or enforcement questions for local legal review, and translate agreed requirements into SOPs, approval routes, evidence standards and monitoring. Support can include promotional materials review coordination, HCP and event workflows, sample controls, reporting checks, training and automation. India-specific legal advice, licensing work or formal local appointments must be separately scoped with appropriately qualified local professionals; this guide does not claim India-based representation.

The Department of Pharmaceuticals describes UCPMP 2024 as mandatory. It establishes ethical standards for pharmaceutical promotion and industry interactions with healthcare practitioners. Complaints are handled through association-level Ethics Committees for Pharma Marketing Practices, with an appeal mechanism at the Department of Pharmaceuticals. The Code is a distinct compliance layer alongside statutory requirements.
UCPMP says a drug must not be promoted before competent-authority marketing approval and that promotion must remain consistent with that approval. Claims should be current, balanced, verifiable and capable of substantiation. The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 separately prohibits misleading drug advertisements and advertisements for specified diseases and conditions. Review intended audience, content and channel against the product approval and applicable law.
UCPMP prohibits gifts or personal benefits for healthcare practitioners and their family members, as well as pecuniary advantage or benefits in kind to people qualified to prescribe or supply drugs. It also restricts company-funded travel and hospitality, with limited Code conditions for speakers at CME/CPD programmes; monetary grants to HCPs or family members are prohibited. Build documented purpose, approvals, contracts, event controls and escalation into engagement workflows.
The Code requires well-defined, transparent and verifiable guidelines for industry engagement in CME/CPD and related events. It prohibits events in foreign locations, identifies eligible organiser categories, and requires companies to publish event and expenditure details on their websites. Organisers must disclose participant and speaker selection procedures, funding sources and expenditure; the Code also sets a 1:10 speaker-to-participant ratio for covered in-country events. Confirm the exact event model, organiser and applicable provisions before committing support.
Samples may be supplied only to people qualified to prescribe the product, for awareness and experience, and must be recorded and controlled. UCPMP limits sample packs to the prescribed course for no more than three patients and no more than 12 packs per drug per practitioner each year; packs must be marked not for sale and cannot exceed the smallest market pack. The total monetary value of samples should not exceed 2% of domestic sales. The 2025 amendment clarifies sample valuation for annual reporting.
Under the UCPMP text updated on 1 September 2025, the executive head submits an annual marketing-expenditure disclosure within two months after the financial year, through a member association or the Department of Pharmaceuticals portal where the company is not an association member. The prescribed form captures domestic sales, sample value and HCP recipient counts, and education-programme expenditure and event counts. Separately, CDSCO says states primarily regulate manufacture, sale and distribution of drugs, while central authorities handle functions including new-drug approvals, standards and import quality. Map the state footprint and applicable licensing or enforcement touchpoints.
